second hand unlocked iphone, is it jail broken

Hi have bought a second hand iphone fw 3.12. it had been unlocked before i got it, i now use it on t-mobile, but when it arrived it came with a little note that said do not updated the phone through itunes or it would be sim locked back to o2, does this mean that:
1 the phone has been jailbroken ? even though i dont have cydia on it
2 if not will i be able to jailbreak it without it locking to o2,
3 if i do jailbreak it will i lose all the apps i have purchased,

It's hard to say, but to play on the safe side do not upgrade your firmware.

If you are happy with the phone leave it as it is.

If you re-jailbreak and unlock using Blackra1n and Ultrasn0w you will not lose any of you programs

3G or 3GS?
Assuming your BB is 05.11.07 it has been JB and unlocked with BlackSn0w (UltraSn0w only works with BB 04.26.08)
Updating your FW in iTunes will update your BB and you will lose the unlock.

Hi all
Thanks for the replies, sorry i didn`t think to mention the phone is a 3gs, not sure what bb means but i checked the phone for the dates mentioned and it says the modem firmware is 05.11.07, is there anyway to check if its still jailbroken ? or is it possible for the person i bought the phone off, was able to jailbreak then unlock and then lose the jailbreak again ? (if that sense),
the phone is working perfectly so i wouldn`t update it through itunes,

BB is Baseband - the term is interchangeable with Modem Firmware AFAIK.

When folk refer to FW (firmware) however, they usually mean the iPhone OS version.

For example my FW is 3.1.3, BB 05.12.01

The phone was JB with BlackRa1n then unlocked with BlackSn0w, BlackRA1n was then removed.
So the phone is still JB.
If you upgrade your FW you will lose the JB and the unlock.
Be very careful - if anything goes wrong and you have to restore your FW you will not be able to restore to 3.12 and will be forced to restore to 3.13 (unless the previous owner saved your SHSH in cydia).
